Terms of Service
Please read these Terms of Service carefully before utilizing the BreezyPay operations command center, financial automation tools, or Breezy CFO platform.
1. Acceptance of Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Customer”, “Operator”, or “User”) and BreezyPay Technologies Inc. (“BreezyPay”, “we”, “us”, or “our”). By accessing our website, creating an account, or connecting your PMS, Stripe, or payment accounts, you agree to be bound by these Terms and our Privacy Policy.
If you are entering into these Terms on behalf of a company, partnership, or other legal entity, you represent and warrant that you possess full legal authority to bind such entity.
2. Description of Services
BreezyPay provides a specialized SaaS operating platform for short-term rental cleaning operations, including but not limited to:
- Turnover scheduling and calendar sync engine;
- Cleaner roster management, mobile checklists, and photo inspection verification;
- Automated property manager invoicing and payment settlement workflows;
- Real-time financial telemetry, margin analysis, and AI CFO intelligence.
3. Account Registration & Security
You agree to provide accurate, current, and complete information during registration and to maintain the security of your account credentials. You are solely responsible for all activities that occur under your account. You must notify BreezyPay immediately of any unauthorized access or security breach.
4. Invoicing, Payouts & Fees
Platform Subscriptions: Subscription fees are billed on a recurring monthly or annual basis as specified during plan selection. All fees are non-refundable except where required by law.
Payment Processing & Stripe Connect: Payment processing services for property manager billing and cleaner payouts are facilitated via Stripe Connect and subject to the Stripe Connected Account Agreement. By utilizing automated payout features, you agree to maintain sufficient funds in your linked settlement accounts.
Operators remain solely responsible for determining tax liabilities, worker classifications (independent contractors vs. employees), and providing appropriate tax reporting documents to their field cleaners.
5. Scheduling & Field Verification
BreezyPay provides software tools to facilitate turnover assignments, photo proof uploads, and inspection workflows. BreezyPay does not provide cleaning services and is not an employer of the cleaners assigned by operators. Operators and property managers remain solely responsible for the physical quality, timeliness, and safety of turnover services.
6. Intellectual Property & License
BreezyPay retains all right, title, and interest in and to the platform, including all algorithms, interface designs, trademarks, and documentation. You are granted a non-exclusive, non-transferable, revocable license to access and use the platform solely for your internal business operations.
7. CFO AI Advice & Disclaimers
Breezy CFO and associated AI diagnosis engines provide automated financial calculations, scenario simulations, and operational metrics based on user-provided data. Breezy CFO does not provide certified legal, certified public accounting (CPA), tax, or fiduciary financial advice. Operators must independently review and verify business decisions.
8. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall BreezyPay Technologies Inc. be liable for any indirect, punitive, incidental, special, or consequential damages, including loss of profits, data, or business opportunities arising out of or related to your use of the platform.
9. Term & Termination
You may terminate your account at any time through the platform settings or by contacting support. BreezyPay reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or fail to settle outstanding subscription fees.
10. Governing Law & Contact
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
